CBP Announces Intent to Make CDSOA Distributions in FY2020

Today, the Federal Register published U.S. Customs and Border Protection’s (“CBP”) “Notice of Intent to Distribute Offset for Fiscal Year 2020.” Per the notice, for fiscal year 2020 distributions of Continued Dumping and Subsidy Offset Act (“CDSOA”) funds, certifications must be received by the agency by July 27, 2020.
CBP also recently issued a preliminary report regarding CDSOA funds that may be available for distribution in fiscal year 2020. This report identified a preliminary amount available to disburse of $186,372.37 in duties collected on shrimp imports that entered the United States prior to October 1, 2007. Moreover, on November 25, 2019, CBP reported that a total of $667,359.76 remained deposited in clearing accounts related to the shrimp antidumping duty orders at the end of fiscal year 2019.
CBP has made CDSOA disbursements to the shrimp industry each of the last fourteen years in varying amounts. Two years ago, CBP reported that there was also a total of $667,359.76 deposited in clearing accounts related to the shrimp antidumping duty orders at the end of fiscal year 2018, the same amount as what the agency has reported as deposited at the end of fiscal year 2019. Nevertheless, the agency ultimately distributed a total of $135,836.19 in CDSOA funds from antidumping duties collected on shrimp imports in fiscal year 2019. This represented a slight increase in CDSOA fund disbursements over the $126,136.22 sent out by CBP for fiscal year 2018.
Since 2006, $268,831,313.13 in collected antidumping duties on shrimp imports have been made available for distribution to the shrimp industry through CDSOA.
