CBP Announces Intent to Make CDSOA Distributions in FY2021

Today, the Federal Register published U.S. Customs and Border Protection’s (“CBP”) “Notice of Intent to Distribute Offset for Fiscal Year 2021.” Per the notice, for fiscal year 2021 distributions of Continued Dumping and Subsidy Offset Act (“CDSOA”) funds, certifications must be received by the agency by July 27, 2021. 

CBP also recently issued a preliminary report regarding CDSOA funds that may be available for distribution in fiscal year 2021. This report identified a preliminary amount available to disburse of $57,689.29 in duties collected on shrimp imports that entered the United States prior to October 1, 2007. Moreover, on December 3, 2020, CBP reported that a total of $189,683.37 remained deposited in clearing accounts related to the shrimp antidumping duty orders at the end of fiscal year 2020.

CBP has made CDSOA disbursements to the shrimp industry each of the last fifteen years in varying amounts. Last year, the agency made $409,298.83 in collected antidumping duties on shrimp imports available for distribution under the CDSOA program, up from the $135,836.19 made available in fiscal year 2019 and the $126,136.22 made available in fiscal year 2018.

Since 2006, $269,240,612.22 in collected antidumping duties on shrimp imports have been made available for distribution to the shrimp industry through CDSOA.
