Today, the U.S. International Trade Commission’s (ITC) schedule for the agency’s conduct of the third sunset reviews of the antidumping duty orders on frozen warmwater shrimp from China, India, Thailand, and Vietnam was published in the Federal Register.
The ITC will hold a public hearing for the sunset review at 9:30 am on April 11, 2023. Requests to appear and participate in the ITC’s hearing are due no later than March 30, 2023. For those testifying or presenting at the hearing, written statements and slide presentations must be submitted to the ITC by April 10, 2023.
The agency intends to issue a prehearing staff report by March 20, 2023. The deadline for filing prehearing briefs to the ITC is March 29, 2023, while posthearing briefs are due to the agency no later than April 20, 2023.
The ITC intends to release the final information and evidence to comprise the administrative record in the sunset review by May 18, 2023. All parties to the proceeding will then have until May 22, 2023 to submit final comments before the Commissioners of the agency vote on whether to continue or terminate the trade relief.
In addition to issuing the schedule for the sunset review, the ITC also announced that it was exercising discretion granted to the agency pursuant to 19 U.S.C. § 1675(c)(5)(B) to extend the time limit for completing the sunset review for up to 90 additional days. With this exercise of discretion, the ITC will have until July 17, 2023 to complete the review.
